FIDUAM Luxembourg may act as depositary of bearer securities in its capacity as domiciliation agent authorized by the “OEC”.
With the entry into force of the new law of July 28, 2014, bearer shares will now be immobilized with a professional depositary who will be subject to the applicable obligations in the fight against money laundering and the financing of terrorism. The law applies to bearer shares of public limited companies and limited partnerships by shares.
Chartered Accountants are among the people who can act as depositaries.
The depositary must keep a register of bearer shares. This register indicates in particular the designation of each shareholder, the number of shares held and the transfers or sales made.
